As with any Business there are terms and conditions.

All images captured by P&K Making memories are copyright protected and the rights and ownership remain with P&K Making Memories.

Photographs are protected by copyright just like any other piece of creative work, and is protected in UK law by the Copyright, Designs and Patents Act 1988 and some EU directives that came into force in 1989, and under these acts they come under the classification 'Artistic Work'. The overall policy of this legislation is 'to prevent the unauthorised copying of material forms of expression resulting from intellectual exertions of the human mind' ... To put this simply it prevents the copying of an actual piece of work, but not the use of the information, thoughts or emotions expressed within it. Copyright not only protects you against unauthorised reproduction of your photos, but also entitles you to economic benefit and seeks a fair balance between you and the user.Copyright is established from the moment the image is created - the only qualification is that it has to be original. It is a right granted to the photographer under the law and it comes into force immediately. These rights are then held by the photographer through your lifetime and for 70 years beyond your death, when it is transferred to your heirs. Beyond 70 years it becomes public domain. This is a little over-simplified as with all laws there are exceptions and because of some EU directives, which came into force in 1996, extending the period from 50 years to 70 years and therefore bought some items back into copyright, known as 'revived copyright', and also special protection for non-European artists where their protection extends to the length of time it is protected in their country of origin.

The copyright owner has the exclusive right to authorise the reproduction of a his work in any medium by any other party. Any reproduction can only take place with the copyright owners consent, permission usually being granted with the payment of a fee.

However, we will arrange permissions with each individual on a case by case review. Usually at events we don't mind distributing our images free of charge or for a donation.

We DO NOT consent to people using our photos for commercial or financial gain WITHOUT our written consent.

We will take legal action against anyone who abuses our copyright and business.

What We Provide

We provide a photography service aimed at capturing still images in a wide range of scenarios.

This could be studio based photography, On location photography, Parties, Social events, Formal events and public events.

We also offer our photobooth setup. This is a portable studio where we offer Free digitals, Keyrings, Magnets, prints and more.

We have appropriate camera and lighting equipment to cover most scenarios. In the extent of needing more for a specific job this may incur extra costs.

Fees.

P&K Making Memories is a business. However, we aim to make our services available to everyone and work within clients budgets where possible. Our website provider incurs Fee's on transactions we cannot control but is included in the cost price when making a purchase.

Our products are fulfilled by a 3rd party that set their own prices which again is out of our control. We will always take any issues seriously and work together to come to a satisfactory resolution.

Privacy.

P&K Making Memories take individuals privacy seriously. We operate in a way that regardless of reason, If an individual does not want their Image putting on public display we will do our best to follow that request. We will create a client gallery so the individual can privately access their Image/s.

Due to sheer volume there may be images appear accidentally, but to resolve this please get in touch and let us know so we can rectify this at first possible opportunity.

P&K Making Memories cannot be held responsible for group shots where individuals appear in the image, however measures can still be taken to remove the identity.

Bookings.

We operate on a first come first served booking system.

Please get in touch through our contact us page to start a booking application.

When making contact regarding a booking we ask for a 10% non-refundable deposit to confirm the booking and that date will be reserved. Full payment must be made 7 days prior to the booked date. There are exemptions that can be arranged on a case by case basis.

Content.

P&K Making Memories aim to be a family friendly age appropriate business. We do not accept responsibility for the conduct within some images where individuals are responsible for their own conduct. This is due to coverage of events where alcohol is sold and misbehaviour can occur. We will do everything we can to remove / make private any images that may offend others.

Artistic license is taken with some images that have multiple perceptions. NO OFFENCE in intended with any of our work. If there are any questions regarding specific reasons or meanings behind an image we will happily provide an explanation behind it.

Safety

P&K Making Memories takes safety very seriously. We minimise as many risks as we can. Any photos using pyrotechnics, Fire, Smokebombs, Props etc. have been handled safely with appropriate measures taken to reduce any risk, and to deal with any incident that may or may not occur.

Digital Freebies

We endeavour to provide our digital images for free. This is aimed to the individuals within the photo and not a license to download other peoples images without their consent. Once downloaded, you are free to use YOUR photos for social media and personal use.

Commercial or Financial useage is FORBIDDEN, unless permission has been granted in writing.

Donations.

The Donations page is to gather funds to keep attending events and to travel further afield. This allows us to continue capturing memories for people and to provide them here on this website. Donations are voluntary and there is no minimum or maximum amount. All funds are appreciated.

Blog.

The Blog is our personal opinion and review. It is not the opinion of any event, client or persons contained within the Images. It is to keep a log of events we attend and jobs we do to share our journey and experiences.

File Storage and Time Limits.

All Images are kept indefinitely on a secure external hard drive. We aim to keep all images for a minimum of 2 years. If after this time frame images are requested there may be a time delay to find the requested images. In the event of equipment failure we will not be held responsible for the loss of any images that are older than 24 months.

Complaints Procedure.

In the unlikely event that you have a complaint to make for any reason.

Please use the contact us page to make your complaint in the first instance.

We will get back in touch at first opportunity.

Together we will try to rectify and situation on both sides and move forwards together.

Abuse & Damage policy.

P&K Making Memories aims to provide a happy and friendly service for everyone.

Abuse either in person or digitally WILL NOT be tolerated UNDER ANY circumstances.

If abuse is given it can lead to us leaving an event, asking for those responsible to be removed from the event and legal repercussions.

Those responsible will be liable for any costs, losses or damage caused by their actions and will be actively pursued.

Accidents can occur and P&K Making Memories understand this. If damage occurs due to negligence on our part we accept full liability. In the event of minor damage due to a genuine accident we may accept liability.

If equipment is Damaged deliberately regardless of the issue being directed at us or as collateral. We will seek costs from the individual/s that are responsible for causing any damage to replace any items that are damaged.

Video

P&K Making Memories is a photography company. although we occasionally take videos at request we do not charge for this. Nor will we accept liability for the video. We often take video for our own personal use or as a favour to a client but we are not commercial videographers.

Refunds.

Deposits are non refundable but P&K Making Memories reserve the right to change this at our discression.

Refunds are at the discression of P&K Making Memories.
